90 day warranty begins with purchase, even for a gift

This is my Cuisinart Sucks story:: I purchased 2 refurbished Cuisinart SS-700 Single Serve Coffee Brewing Systems to give as gifts. I gave one to my son as a gift approximately 4 months after purchase and the coffee maker did not work. Cuisinart and been contacted many times by email and phone and they say because it is after the 90 day warranty period for refurbished products there is nothing they can do.

This coffee maker was not opened during this 90 day period because as I stated it was purchased as a gift. Cuisinart does not care about this and their customer service is anything but customer service.
